  1. A will is a document satisfying certain formal requirements by which a person plans for the disposition of his or her assets after death
  2. In Connecticut anyone who is at least eighteen years old and of sound mind can make a will.
  3. A will executed in the State of Connecticut must be in writing. It also must be signed by the person making the will. It must also be signed in the presence of two witnesses who must sign as such in the presence of the person making the will.
  4. A will remains in effect until it is revoked. A marriage, divorce, birth or adoption of a child will usually revoke a will unless a provision is made to cover that occurrence. Additionally, a will can be revoked at any time during one's life by making a new will and/or revoking the existing one.
  5. By having a will, an individual can plan and provide for the particular needs of his or her family. Without a will, state Intestate laws (a rigid formula of distribution based on relations) determine the family needs and wants without your consent.

Here are some things you may want to know about creating a Trust before your consultation:

A Revocable Trust (also called a Living Trust) is the most chosen type of Trust used for estate planning purposes. A Revocable Trust is a Trust which is for your benefit. You, as the grantor or trustee and beneficiary, remain in charge of said Trust while you are alive.

Once you are deceased, the Trust sets forth a successor trustee who manages and oversees the Trust and distribution of assets in accordance with the Trust provisions and terms of distributions to successor beneficiaries.

A Revocable Trust can accomplish many of the same goals as a Will with the benefit that the Trust assets do not go through the probate process upon the grantor’s death. Probate is often a more lengthy process with unexpected fees. During the probate process and prior to court approval, beneficiaries often do not have immediate access to inherited funds until probate of the assets is concluded.

A Revocable Trust (with some exceptions) bypasses most of the probate requirements, making assets quickly available to beneficiaries without the delay of probate court. A Revocable Trust also allows the grantor, who is also the beneficiary and trustee of their own Trust, to revoke or alter the Trust during their lifetime. After the grantor or trustee’s death the Trust becomes irrevocable, and assets are distributed to the named beneficiaries of the Trust by the grantor who made the Trust.
